rights to European dance artist Abie Flinstone, and has initiated
marketing of her newest single, ?Get Outta My Way,? pursuant to a

available through all digital outlets by April 20, 2012.

Abie Flinstone?s single has already achieved success in Europe,

Should Trayvon Martin's Mother Have Filed a Trademark Application ...

This is an interesting way, by the grieving family, to preserve the memories of Trayvon Martin (RIP), the 17year old unarmed black kid shot by an overzealous self designated neighborhood watchdog, George Zimmerman (White &/Hispanic). Abovethelaw.com debates the issue:

?The shooting has picked up national attention, and it?s shedding yet another ugly spotlight on race relations in America. I?m on the same page as Elie regarding most of his frustration. But earlier this week we learned that the slain teen?s mother had filed a trademark application for ?I am Trayvon? and ?Justice for Trayvon.?

Elie thinks, in a nutshell, that this is a good and proper strategy to preserve Trayvon?s memory and prevent random people from profiting off of his death. But I have to disagree. I think his family members are wasting their time and energy.

U.S. Patent and Trademark Office filings by Sybrina Fulton are for the sayings ?I am Trayvon,? and ?Justice for Trayvon.?
The applications, filed last week. A representative for Fulton says the trademarks were not filed for ?profitable purposes.?
Now, on to the debate.

The problem here is that filing a trademark application is not worth the time, or the effort, or the money for Martin?s family. I understand Fulton is concerned about people exploiting her son?s memory, and I know the intellectual property regulatory system is one official way to prevent others from doing just that. But I really don?t think anyone is going to make any significant profit off of Trayvon t-shirts. And, even if unintentionally, Fulton?s filing automatically raises questions about her motivation, regardless of whether she?s actually trying to profit from the trademarks.

Even so, the family will almost certainly not have the resources to enforce the trademark. They will not be able to do anything about Times Square street vendors ? who mostly sell copyrighted stuff anyway ? or other independent t-shirt makers. And I am pretty sure Urban Outfitters is not going to try to cash in on this.

Just because Sinbad wore a Trayvon shirt on a morning show doesn?t mean people are getting rich off of Trayvon?s name.

Moreover, t-shirt sales are a non-issue. Fulton?s application doesn?t cover apparel. The Daily Mail notes . . .?

Correspondence ? Big Bend Now

I was on my way to Alpine Friday morning when I found our family dog in the highway. He had been hit by a car and was killed. I pulled over, got out of my truck and started walking toward him. I was in tears and didn?t know what I was going to do.

Just when I thought I was going to have to leave him on the side of the road the Lord sent me an angel. Mem Hall, a longtime Marfan, who is also a cowboy, stopped to help me. He asked if I had a special place to take him and I told him no. He gave me a hug and said he understood how hard it is when a pet dies. He picked him up and told me he would take care of him for me. He gently laid him in the back of his truck and drove away.

It really warms my heart to know that people like this still exist, and so fitting that it was a cowboy from Marfa.

Thank you so much Mem Hall for being so kind that day. I will never forget it.

It is important to understand that sexuality is much more than sex. Healthy sexuality is emotional, social, cultural and physical. It is our values, attitudes, feelings, interactions and behaviors. It changes with time and experience.

Individuals need accurate information about relationships, sexuality and positive behaviors to ensure the opportunity to make healthy sexual choices. These choices impact our lives, loved ones, communities and society.

All of us have a role in building safe, healthy relationships and communities. When we start the conversation about healthy sexuality, we raise awareness. Prevent sexual violence by talking about ?it.?

It has been interesting following the plight of the feral burros at Big Bend State Park over the past couple of years. I believe this issue has been made way too complicated. For the price of some beer and a nice trophy belt buckle, the park could have a wild burro roping like we used to have every year at the Adams Ranch in South Brewster County. Forty-five or fifty cowboys showed up every year, and almost all of the burros were roped, put into trailers, and not harmed. A couple of weekends like that, and TP&W could have the entire problem solved for less than a thousand bucks.

Now they are in cahoots with one of the most devious and destructive organizations in the country, HSUS (Humane Society of the United States). These are not the same people as your local ?humane society? folks. This organization is made up of total ?animal rights? radicals. They want to end all hunting and all raising and use of livestock in the US. They despise ranching, and will do whatever it takes, legal or otherwise, to destroy it.

I strongly suggest you do a little research on this group, and then let Parks and Wildlife and your elected officials know how you feel.

I am a very angry senior citizen of Marfa, Presidio County, Texas and the United States of America.

I am angry about the greed, dishonesty, lies, stupidity and lack of leadership in our government from top to bottom.

President Obama appointed Mrs. Clinton as Secretary of State where she has served with dignity and intelligence, but she took office with three strikes against her. Most of our foreign problems have been in the Middle East where women are not recognized. He has been indecisive on energy policies as well as others.

Nationally, I am in favor of term limits, 2-4 year terms in the House and 2-6 year terms in the Senate, 8 years in the Supreme Court.

I fail to see any evidence of leadership by the Democrats and the Republicans. Pensions for these officials should be very small.

In Texas, how has Governor Perry represented Texas? Poorly. Did he continue to draw his salary while he was running for the White House? Is the very expensive resort necessary for his living arrangements? School funds for the state have been cut and costs for higher education have been raised. Does this make sense?

Locally, I do not know both sides of the problems. The appointment of the Water Board was ridiculous and dangerous. I hear rumors that official offices at the courthouse are being violated. The county taxes are ridiculous considering the amount of services we receive from the county. How have we been so unlucky to have commissioners that are more interested in their high pay than in the county?

How has the city lost so many businesses to Alpine?

The school is forced by the state legislature to implement many policies that do not server our students well. Going to college is not a requirement for many students. They need a home economics department to learn how to cook and sew and to learn family management. They also need to learn practical ways to make a living.

For all my former students: I am getting old and my eyesight is failing. I love to work Sudoku and crossword puzzles and it is hard to read the numbers. Remember how I used to fuss at you for putting a bar across the seven? It works great in helping me distinguish the numbers. Thanks kids!

Questions by liberal justices during the first day of oral argument before the US Supreme Court, led to news reports that the Court is leaning to uphold Congressional healthcare legislation. On the second day, a question by a conservative justice; whether the government could force people to buy ?cars, broccoli or burial insurance?, has given rise to reports the court is set to overrule the centerpiece of President Obama?s legislative agenda.

All good concerns and questions, but whoa, stay tuned-in! Let?s not get too far ahead of ourselves. A series of questions from one or the other Justices isn?t a sure fire way to predict a final opinion about the fate of healthcare or any issue before the court.

I admit this is interesting for a former history, then political science major and lawyer.? An opinion is only as good as the number on one side or the other the court?s majority convinced during a review of the briefs, oral argument and behind the scenes give and take when the justices meet in-private to discuss the issues and review the preliminary opinion of the other 8.

Talking about a particular outcome is an interesting exercise for sitting around the table at the ?B & B?, watching cable news panels of experts or my law school Constitutional Law professor toying with his students like a cat with a ball of yarn. But much like a baseball game, we cannot determine the outcome of the game from any one controversial play or call by an umpire.

The question from the conservative justice about broccoli is a good one; but the answer depends upon a number of factors. And the result could change in another generation with another set of justices. The next day, regardless of result, people will be hard at work trying to convince voters; to convince their legislators, of the merit of the present or former position and the music goes round and round. The doctrine of ?separate, but equal? is a good example; but it is not the only instance. So why is that?

First of all, the law isn?t a set of concepts carved in granite for all time. Our sense of right and wrong evolves.? Civilizations accepted slavery as a given; note Moses? and Uncle Tom?s experience under the whip. Racism looked the other way; knowing full-well that facilities of ?while only? were superior ? be it water fountains, public pools or school districts.? In the South; was full citizenship possible when state legislation prevented blacks from voting?

Those with a longer memory than our retiree newcomers know about the relationship between Hispanic residents living on the south side of the tracks in Alpine and the Anglo population.? The high schools and movie theatres were segregated and the police kept an eye on the crossings least, after a certain hour of the evening, ?they? head north.?? Water pressure on the south side was a generational embarrassment to any sense of fairness.

Slavery ended for blacks more than 100 years ago and there isn?t a cop at the crossing gates by the tracks these days.? But generations of old attitudes haven?t always been as quick to change as the ink to dry on a legislative measure signed by the President or Governor.

State and federal constitutional standards determine constitutionality of any law or executive measure passed and sought to be enforced ? from the federal to the local level and everything in-between.? Here is how a court decides a matter:? First, understand that a court only has the jurisdiction provided by the constitution and laws of the state and/or federal government.? Judges have been unfairly labeled ?activist?.? They do not seek-out extra work.? If it wasn?t for a dispute presented to them by the litigants, they would be sitting around twiddling their thumbs.

For sake of argument, let us say that reducing insurance costs and covering every individual is a legitimate governmental interest and your state?s legislature passes a piece of legislation, signed by the governor.? Someone has standing and the matter is taken to court.? The judge?s role is to first determine if there is ?a legitimate governmental interest?.? If so, then the court asks ?is the measure(s) taken to advance that governmental interest, reasonable??

Recent examples include laws requiring voter identification or a woman listening to a fetal heartbeat, watch a sonogram of the fetus and wait 24-48 hours before undergoing an abortion.? The question is whether there is a legitimate governmental interest and whether or not the law (as a whole or a particular portion), is an overreaching of governmental authority.?? Another way of saying it is the government cannot ?take a sledge hammer to a fly; rather use measured steps to deal with a legitimate concern, such as employing a vaginal probe as an agent of the state.

Under the Federal constitution, the ?powers reserved to the states?, include public welfare and safety; including matters of public health and police powers.? Regardless of result, to the end of our days, reasonable people will more than likely differ and see things quite differently.? We still debate the constitutional merits of the 1803 SCOTUS Marbury vs. Madison decision; whereby the early Supreme Court took upon itself the power to declare acts of the Congress and President unconstitutional ? although such power was not enumerated under the Articles having to do with the Judiciary.

Having said that, whether a decision is right or wrong often depends upon which side of an issue is supported.? If you tend to agree with federal standards; such as a maximum speed limit on the Interstate or prohibiting discrimination in employment or public municipal transit systems or accommodations in restaurants and hotels ? under the ability to regulate ?interstate commerce? ? you may not consider it an ?over-reaching? of federal authority.? If you believe there is federal overreaching in the present healthcare legislation, you may be doing handstands that so many State Attorney Generals have taken the matter to the Supreme Court under the ?states? rights? philosophy, once used to deny blacks bedrock American rights.

I sincerely wish the public had a much better understanding of the legal standards applied to determine the constitutionality of the actions of a unit government ? be it the president, mayor, employee in the clerk?s office or anyone in the public?s employment.? Perhaps there would be less misinformation promulgated on talk radio and TV and around the breakfast table, concerning important issues before the courts and before going off the deep-end due to unsubstantiated, exaggerated claims about (federal, state or local) governmental overreaching.

Indeed, there may be overreaching in aspects of the federal healthcare legislation.? But if we say there is, we need to give more of a hoot when a local cop stops someone of a racial or ethnic background (defined as ?different from me?), for a spurious reason of less weight than a helium-filled balloon.? A legitimate argument could be made, that ?There is much more tyranny when the police take you into custody in handcuffs without legitimate probable cause; than the government acting to reduce the outrageous cost of health insurance or to protect citizens from insurance companies bending over backwards to decline a meritorious claim.?

It is said our forefathers (and mothers) rid themselves; to our enduring benefit, of the King of England and his local representatives.? Here in Texas, we did the same with Generalissimo Santa Anna.? Each was accused of being a heavy-handed, authoritarian despot in their own, unique way.

A peasant or Apache forcibly removed from ancestral lands may see things differently than the person doing the removing and then, profiting from it for generations to come.? Substitute ?a President and Vice-President claim there is weapons of mass destruction? for ?when policemen break the law?.? Heavy-handed authoritarianism IS heavy handed regardless of whether or not our own ox is gored.? ?In a constitutional republic; such is our federal government, we?ll always have another day to advance out positions and convince enough people to sway the majority our way, were we not to prevail during an election cycle or in the courts. ?Walking a mile? in another?s? shoes is a good way of understanding their perspective.

Few among us are so intellectually pure to be ?spot-on? in every situation across the board.? Reasonable people of all political stripes can and will differ for genuine political and philosophical reasons.? Let us do so reasonably.

(AP) ? The Supreme Court will begin hearing arguments on Monday over President Barack Obama's health care overhaul, the Patient Protection and Affordable Care Act, derisively labeled "Obamacare" by its opponents. A look at how the case will unfold before the court in question-and-answer form:

A: The Supreme Court is hearing a challenge to the Patient Protection and Affordable Care Act, which is Obama's signature domestic achievement. Passed by Congress in 2010, its aim is to provide health insurance to more than 30 million previously uninsured Americans, while trying to restrain costs and prevent disruptions to the majority already with coverage. A: The chief justice is John Roberts, who joined the court in 2005 after being nominated by President George W. Bush. In order of seniority, the other justices are Antonin Scalia (confirmed in 1986 after being nominated by President Ronald Reagan), Anthony Kennedy (1988 by Reagan), Clarence Thomas (1991 by President George H.W. Bush), Ruth Bader Ginsburg (1993 by President Bill Clinton), Stephen Breyer (1994 by Clinton), Samuel Alito (2006 by President George W. Bush), Sonia Sotomayor (2009 by Obama) and Elena Kagan (2010 by Obama.)

Q: Who will be arguing for the law?

A: Solicitor General Donald B. Verrilli, Jr. will argue for the government on Monday and Tuesday. Deputy Solicitor General Edwin S. Basketball Physics: The Anatomy of the Free Throw

In theory, the free throw is a gift. The shooter shoots with no elbows thrown in his direction, no seven-foot-tall man trying to block the shot, and no screaming crowd (unless he plays for the visiting team). So what makes this solo shot so choke-worthy? In the spirit of March Madness, we break down the anatomy of this seemingly simple shot.

Body Mechanics


"The lift that you have as a free-throw shooter starts from the feet," says Bruce Kreutzer, a shooting specialist at the Mark Price Basketball Academy in Suwanee, Ga., who has been working with the NBA and amateur players for 25 years. "The majority of players today use their upper body first, which really throws off the rhythm."

When they step up to the line, players should align their body?toes, hips, and shoulders?directly with the basket, Kreutzer says. Seems easy enough, but things soon become complicated. The amount of bend in the knee needed to make a shot is directly proportional to a player's distance from the hoop, and players often struggle to find the amount of bend that correlates with the right amount of energy buildup. Too much energy and your shot is a brick off the backboard; not enough and it's an air ball.

As a player prepares to shoot, the ball should be resting on the finger pads (that first roll of knuckles just above your palms) and not the fingertips, Kreutzer says?"This way there's no snap, just a rhythmic flop." The same goes for the rest of the body; the shooter's weight should be traveling forward in a controlled calf-raise motion.

Debunking the Swish


North Carolina State University mechanical engineering professor Larry Silverberg, an avid baller himself, set out to determine the physics behind the perfect free throw. With his colleague Chau Tran, he co-wrote a software program to analyze three-dimensional computer-simulated free-throw trajectories.

"If you take top athletes in any sport, most have a really hard time explaining what they're doing," Silverberg says. "By simulating millions of shots we could see patterns that tend to confirm best practices."

Their extensive research allowed them to establish a few guidelines for the foul line: aim toward the back of the rim with 3 Hz of backspin and at 52 degrees to the horizontal. Oh, and do all this at a perfectly smooth and consistent speed.

Let's take the first piece of advice: Aim for the back of the rim. Despite what most people may think, Silverberg found that aiming for the center of the basket actually decreases the likelihood of a successful shot by almost 3 percent. Silverberg and Tran found that the sweet spot is actually 2.82 inches past the center of the hoop. You might make less "nothing but net" shots this way, as the ball is more likely to hit the back of the rim and go in, but your overall shooting percentage will be greater.

Second piece of advice: the backspin. Three Hz of backspin translates to three complete revolutions of the ball before it reaches the hoop, and the reason you want this backspin is that it deadens the ball, should it hit the rim or backboard during flight. In their simulations, Silverberg and Tran found no additional advantage to more than three revolutions; plus, they found that players struggle to put more backspin than this anyway.

Finally, the angle: Without a protractor in your sneakers, it might be difficult for players to execute a launch angle of exactly 52 degrees. The shorthand version that Silverberg tells players, then, is to shoot the ball so that it's about 2 inches below the top of the backboard at its highest point.

"Imagine you drew a line from where the ball is released to the hoop?that's the angle from the horizontal," he says. "A good way to visualize this is aiming pretty close to the top of the backboard at the top of [the ball's] trajectory."

Of course, this is a loose rule, in part because basketball players vary wildly in height. Silverberg and Tran came up with the 52 degrees rule for a six-foot-six player, so the angle would be different for a seven-foot center, a six-foot-six point guard, or a five-foot-eight insurance salesman playing with buddies on the weekend.

But of all the parameters of the free throw, maintaining a constant speed is the most important but also the most difficult, Silverberg says. Unlike the geometric conditions, backspin and speed are variables that rely on the shooter's ability to maintain a consistent motion?arguably the most difficult aspect of any shot.

Pinterest updates Terms of Service, drops the "sell"

Since Kalliopi and I wrote about our views of Pinterest?s Terms of Service, I?ve noticed a common misconception in many blogs, tweets and comments.

Some of these sites even post the Terms of Service from sites like Tumblr or discuss Facebook?s ToS with an eye that they are the same. One of the reasons I singled out the ?sell? and ?otherwise exploit? portions of Pinterest?s terms is because although they are small words in a long document, they are hugely different and significant.

Sites like G+, Twitter, Facebook, deviantArt and Tumblr do take broad licence to modify and otherwise re-purpose content. ?Much of the reasons for that is it?s a way of keeping up with technology. ?Most social media sites have a mobile version, and these provisions are a way of addressing alterations to content for a different format. As I said in The Promise and Perils of Pinterest, there?s a lot to like about Pinterest ? and as with any website, content creators, whether writers, artists or podcasters have to do some risk assessment to see if putting each piece of content online is worth it. Risk assessment comes with being a creator whether you?re showing your work to an editor, a colleague, or the whole legion of intertubes.

Let me be clear: G+, Twitter, Facebook, deviantART, Flickr and Tumblr (as well as many many other social media and image-sharing sites) do not claim to right to ?sell? and ?otherwise exploit? your content. The idea that this was some sort of stock, boilerplate Terms of Service is wrong.

Pinterest responds?quietly

I indicated in my previous post?s comments that I had been contacted by a community manager at Pinterest; the initial answers were sontradictory enough to cause me to delete the content of my own Pinterest boards. Later I was contacted by a PR representative for the company. It was indicated by the community manager and PR rep that Pinterest was looking to change the Terms of Service and remove the ?sell? portion. Frustratingly, this was all to be off the record. Meanwhile, Kalliopi?s post rocketed up a few thousand Facebook ?likes?, hundreds of tweets sharing our posts were retweeted, Nieman Journalism Lab caught sight of the issue and the Huffington Post carried Kalliopi?s analysis of the Pinterest Terms of Service.

Pinterest Changes Terms of Service

As of Friday 23rd of March 2012, Ben Silbermann and his team announced on their blog, among other changes:

?Our original Terms stated that by posting content to Pinterest you grant Pinterest the right for us to sell your content. Selling content was never our intention and we removed this from our updated Terms.?

The new Terms of Service will officially take effect April 6 2012 and Pinterest will finally actually be similar to other social media and image sharing sites.

For all the people who wrote blog posts, tweets, emails and comments about Pinterest and their over-reaching Terms, you knew it can make a difference. Speak up!

For the people who posted the ?but all sites are the same? sentiments, even if that were true, does that mean you have to roll over and take it? ?Most social media savvy sites like Pinterest do actually listen to their users ? they understand the two-way street.

Will I restore content to my boards? ?We all have several days to read over the new Terms of Service and figure that out.

The Developmental Disabilities Alliance of Western New York (DDAWNY)
invites parents/guardians/advocates of people with developmental disabilities to attend a brief meeting on Wednesday, March 28 at 5 pm at the Opportunities Unlimited of Niagaraoffices, at 2510 Niagara Falls Boulevard, Wheatfield, New York.? The informational gathering, hosted by Niagara Cerebral Palsy, Opportunities Unlimited of Niagara, and Rivershore, Inc. will run from? 5-6:30 pm.? Refreshments will be served.

An information session facilitated by Max Donatelli, Developmental Disability Alliance of WNY Board Member and chair of the DDAWNY Parent Coalition and Self Advocates (also known as, Family Committee Chair) will cover topics such as:

Researchers mount new mission to solve Amelia Earhart mystery

WASHINGTON | Wed Mar 21, 2012 10:16am EDT

WASHINGTON (Reuters) - Scientists on Tuesday announced a new phase in the search to resolve the disappearance of Amelia Earhart, saying fresh evidence from a remote Pacific island may hold clues to the fate of the renowned U.S. pilot who vanished in 1937 while attempting to circle the globe.

U.S. Secretary of State Hillary Clinton joined scientists and aviation archaeologists to unveil the expedition, which will set out from Honolulu in July to probe underwater areas around the Phoenix Islands in Kiribati where they believe Earhart may have crashed 75 years ago.

"When she took off on that historic journey she carried the aspirations of our entire country with her," Clinton said, calling Earhart one of the "fearless optimists" who defined 20th century America.

"Even if you do not find what you seek, there is great honor and possibility in the search itself," Clinton said.

The July mission is part of an effort by the International Group for Historic Aircraft Recovery (TIGHAR) to uncover Earhart's fate, an abiding mystery since she and navigator Fred Noonan left Papua New Guinea en route to Howland Island in the South Pacific on July 2, 1937.

TIGHAR Executive Director Ric Gillespie said that new analysis of a photo taken in 1937 near Nikumaroro island in present-day Kiribati appeared to show what could be the undercarriage of a Lockheed Electra airplane such as the one that Earhart was flying, emerging from a reef.

"It's a strong case, we think, but its circumstantial," Gillespie said.

The July phase will see TIGHAR researchers return to Nikumaroro aboard a University of Hawaii research ship equipped to map and investigate the underwater search area with small robotic submarines.

"There are some very smart people who think we're wrong about this. But there are some very smart people who think we're right about this," Gillespie said.

"The only thing we can do is make a best effort to go and search and look and see what we can find. And it's the searching that's important. It's the trying that's important."

Oceanographer Robert Ballard, made famous by his discovery of the wreck of the Titanic in 1985 and who reviewed the latest Earhart project, said Gillespie's TIGHAR team appeared to have narrowed the "box" in which Earhart's wreckage might be found.

"If you ever want a case of finding a needle in a haystack, this is the top of the list," he said.

"He's got a reasonable box now and he's certainly got all the technology to do it. So all I can say is I wish him a fair wind and a following sea -- and a little luck."
